Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of the Datumbase Terms of Service. By using the Datumbase platform, you agree to comply with this policy. Words defined in the Terms of Service have the same meaning here.

1. Purpose and Scope

This AUP sets out the rules governing your use of the Datumbase Construction Management Software platform ("the Service"). It applies to all users, including site managers, principal designers, principal contractors, and any other individuals who access the Service through an organisation account.

The Service is designed specifically for the management of Construction Design and Management (CDM) Regulations 2015 compliance documentation in the United Kingdom. Use of the Service outside this purpose, or in ways that harm Datumbase, other users, or third parties, is prohibited.

2. Permitted Uses

You may use the Service for the following purposes:

  • Creating, storing, and managing CDM Regulations 2015 compliance documents — including F10 Notifications, Construction Phase Plans, Pre-Construction Health and Safety Information, and Health and Safety Files.
  • Uploading supporting documents directly related to CDM compliance for a specific construction project — for example, drawings, structural reports, method statements, and risk assessments.
  • Tracking the status of CDM documents across multiple construction projects and sites.
  • Sharing CDM documentation with duty holders and other authorised project participants within your organisation account.
  • Exporting and downloading your organisation's CDM documents for submission to statutory bodies, clients, or the HSE.
  • Using the Service for lawful business purposes consistent with the UK construction industry.

3. Prohibited Uses

You must not use the Service for any of the following purposes. Violation of this section may result in immediate suspension or termination of your account without notice.

3.1 Illegal and harmful activity

  • Using the Service for any purpose that is unlawful under the laws of England and Wales or any other applicable jurisdiction.
  • Uploading, storing, or transmitting content that is fraudulent, defamatory, obscene, or in breach of any third party's legal rights.
  • Attempting to access systems, networks, or data you are not authorised to access.
  • Transmitting malicious code, viruses, worms, or other harmful software through the Service.

3.2 Intellectual property violations

Construction documents frequently contain third-party intellectual property. You are responsible for ensuring that any documents you upload do not infringe the rights of architects, engineers, surveyors, or other consultants. Specifically, you must not:

  • Upload drawings, specifications, or reports for which you do not hold a licence to store and share digitally.
  • Use the Service to reproduce, distribute, or exploit third-party copyrighted materials beyond the terms of any applicable licence.
  • Remove or obscure copyright notices or watermarks on uploaded documents.
Note: If you are unsure whether you have the right to upload a particular document, check your appointment or commission agreement with the relevant consultant. Standard RIBA, ACE, or NEC appointment terms typically permit the client to copy and use documents for the construction project but may restrict further use.

3.3 Data protection violations

  • Uploading personal data about individuals beyond what is strictly necessary for CDM compliance purposes.
  • Processing special category personal data (including health information about workers) without appropriate safeguards, except where directly required by a CDM Health and Safety File.
  • Sharing another person's personal data through the Service without a lawful basis.
  • Attempting to circumvent or disable data retention or deletion controls built into the Service.

3.4 Service integrity

  • Attempting to reverse-engineer, decompile, or disassemble any part of the Service.
  • Using automated tools (bots, scrapers, crawlers) to access the Service in ways that place unreasonable load on the infrastructure.
  • Probing, scanning, or testing the vulnerability of the Service without Datumbase's express written consent.
  • Reselling or sublicensing access to the Service to third parties not covered by your subscription.
  • Creating multiple accounts to circumvent usage limits or subscription restrictions.

3.5 CDM-specific restrictions

  • Using the Service as a substitute for professional CDM advice. The Service assists with document management — it does not replace the legal duties of Principal Designers, Principal Contractors, or other duty holders under the CDM Regulations 2015.
  • Deliberately creating false or misleading CDM documentation through the Service.
  • Using the Service to satisfy CDM obligations for higher-risk buildings (Building Safety Act 2022) as the sole means of compliance, without verifying that use meets golden thread of information requirements.

4. Content Standards

All content uploaded to or created within the Service must meet the following standards:

  • Content must be accurate and not deliberately misleading. CDM documents are statutory records — do not knowingly falsify them.
  • Content must not contain material that is offensive, discriminatory, or harassing.
  • Content must be relevant to CDM compliance and construction project management.
  • Files must not contain embedded malicious code or macros designed to execute harmful actions.
  • Content must comply with all applicable laws, including the Health and Safety at Work etc. Act 1974, CDM Regulations 2015, Building Safety Act 2022, and UK GDPR.

5. Third-Party Intellectual Property

You acknowledge that:

  • Architectural drawings, structural calculations, and similar professional documents are typically protected by copyright belonging to the originating consultant.
  • Your appointment agreement may grant a licence to use documents for the project, but this may not extend to cloud storage or sharing with third parties.
  • Health and Safety Files containing documents from multiple consultants may require separate licences or consents.

You are responsible for reviewing your appointment agreements, obtaining any necessary licences, and notifying Datumbase promptly if uploaded content infringes third-party rights.

6. Your Responsibilities

  • You are responsible for all activity that occurs under your account credentials.
  • You are responsible for ensuring all users you add to your organisation account comply with this AUP.
  • Organisation administrators are responsible for the conduct of all users within their account.
  • You must notify Datumbase immediately if you become aware of any unauthorised use of your account or any security breach.
  • You are responsible for the accuracy of the CDM documents you upload. Datumbase cannot verify their accuracy or completeness.
  • Where your organisation acts as Data Controller for personal data processed through the Service, you are responsible for ensuring compliance with UK GDPR and the Data Protection Act 2018.

7. Monitoring and Enforcement

Datumbase reserves the right to:

  • Monitor use of the Service to ensure compliance with this AUP, the Terms of Service, and applicable law.
  • Investigate any suspected breach of this AUP.
  • Remove or suspend access to content that Datumbase reasonably believes violates this AUP, without prior notice where immediate action is necessary.
  • Suspend or terminate an account in the event of a material or repeated breach.
  • Report unlawful activity to the HSE, ICO, or law enforcement.

8. Consequences of Breach

Breaches of this AUP may result in any or all of the following:

  • A formal warning.
  • Temporary suspension of your account.
  • Permanent termination of your account and subscription without refund.
  • Removal of or disabled access to specific content.
  • Legal action to recover losses caused by the breach.
  • Referral to relevant authorities.

9. Reporting Policy Violations

If you become aware of any use of the Service that appears to violate this AUP, please report it to:

Datumbase will acknowledge all reports within five working days and will investigate all credible complaints.

10. Changes to This Policy

Datumbase may update this AUP from time to time. We will notify registered users of material changes by email. Continued use of the Service following notification constitutes acceptance of the updated AUP. The current version is always available at this URL.

11. Governing Law

This AUP is governed by the laws of England and Wales. Any dispute arising from this AUP shall be subject to the exclusive jurisdiction of the courts of England and Wales.
